TriSeven Apparel — Terms of Service

Welcome to TriSeven Apparel. We design and distribute faith-forward apparel with care and integrity. These Terms of Service (“Terms”) govern your access to and use of our website, online store, content, features, tools, products, and services (collectively, the “Services”). By visiting or using the Services, you agree to be bound by these Terms and our Privacy Policy (linked on our site). If you do not agree, please do not use the Services.

1) Access & Accounts

You represent that you are at least the age of majority in your state or province of residence and, if applicable, you consent to allow your minor dependents to use the Services on devices you own or manage.
You may be asked to provide information (e.g., email, billing, payment, shipping). You warrant that all information you provide is accurate, current, and complete, and that you have the rights to provide it.
You are responsible for safeguarding your account credentials and all activity under your account. Do not sell, transfer, or license your account.

2) Our Products

We aim to represent colors and details accurately; however, displays vary by device and settings, so actual colors/finishes may differ. We do not warrant that products will meet your expectations or exactly match on-screen depictions. Natural materials like leather, stone, cork, etc, are all unique and a uniform appearance is not promised.
Descriptions, pricing, and availability may change without notice. We may discontinue products or limit quantities to any person, region, or jurisdiction.

3) Orders

Your order is an offer to purchase. We may accept or decline any order at our discretion. We must process your payment before acceptance. If we decline, change, or cancel an order, we’ll attempt to notify you via the contact information you provided.
Please review orders carefully before submitting; we may be unable to accommodate cancellations after acceptance.
Purchases are subject to our Refund & Return Policy (linked on our site). You represent that purchases are for personal/household use and not for resale or export.

4) Prices, Promotions & Billing

Prices, discounts, and promotions may change without notice. The price charged is the price at checkout and in your confirmation email. Unless expressly stated, prices exclude taxes, shipping/handling, customs, and import charges.
Store prices may differ from other channels. Promotions may have separate terms; if there’s a conflict, promotion terms govern.
You agree to provide current, complete billing information and promptly update payment details (including card numbers and expiration dates). You warrant that you are authorized to use the payment method, and you agree to pay all charges plus applicable taxes and fees.

5) Shipping & Delivery

Delivery windows are estimates and not guarantees. We are not responsible for delays caused by carriers, customs, weather, or events beyond our control. Title and risk of loss pass to you when we deliver items to the carrier. See our Shipping Policy for details.

6) Intellectual Property

All content on the Services—including trademarks, logos, designs, text, images, video, audio, product names, and their selection/arrangement—is owned by TriSeven Apparel or our licensors and protected by applicable laws.
You may use the Services for personal, non-commercial use only. You may not copy, modify, create derivatives, publicly display, perform, republish, download, store, or transmit any materials without our prior written consent.
TriSeven Apparel names, logos, and slogans are our trademarks. Shopify’s names and marks are trademarks of Shopify. Other marks are the property of their owners.

7) Optional Tools

We may provide access to tools or features from third parties on an “as is” and “as available” basis, without warranties or endorsements. Use them at your own risk and review the third party’s terms.

8) Third-Party Links

The Services may contain links to third-party websites or materials. We do not control or endorse, and are not responsible for, such content or sites. Your use of third-party sites is at your own risk. Review their policies before engaging in transactions.

9) Relationship with Shopify

TriSeven Apparel is powered by Shopify, which enables us to provide the Services. However, sales are made directly between you and TriSeven Apparel. Shopify is not responsible for our sales, products, or your transactions with us. You expressly release Shopify and its affiliates from claims, damages, and liabilities arising from your purchases and transactions with TriSeven Apparel.

10) Privacy

Your use of the Services is subject to our Privacy Policy (see site link). Because our store is hosted by Shopify, information you submit is processed by Shopify (and certain service providers) which may be located outside your country. See our Privacy Policy—and Shopify’s privacy disclosures—for details.

11) Feedback & Reviews

If you submit ideas, reviews, photos, designs, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display that Feedback in any medium for any purpose, including to operate and improve the Services.
You represent that you own or control the rights to your Feedback; that you’ve disclosed any compensation; and that your Feedback complies with these Terms. We may monitor, edit, or remove Feedback in our discretion. You are solely responsible for your Feedback.

12) Errors & Omissions

From time to time, the Services may contain typographical errors or inaccuracies (e.g., descriptions, pricing, promotions, shipping charges, transit times, availability). We may correct errors, update information, or cancel orders if information is inaccurate—at any time and without prior notice (including after you submit an order).

13) Prohibited Uses

You agree not to use the Services: (a) for unlawful purposes; (b) to violate laws or regulations; (c) to infringe IP rights; (d) to harass, abuse, defame, or intimidate; (e) to transmit false or misleading information; (f) to upload non-compliant content; (g) to send spam or solicitations; (h) to impersonate others; (i) to interfere with others’ use; (j) to upload viruses/malicious code; (k) to scrape or crawl; (l) to bypass security features; or (m) to reproduce, sell, or exploit the Services without permission. We may suspend or terminate access for violations.

14) Termination

We may terminate or suspend the Services or your access at any time without notice. You remain responsible for amounts due up to the termination date. Sections that by nature should survive (e.g., IP, Feedback, Disclaimers, Limitations, Indemnification, Severability, Entire Agreement, Assignment, Governing Law) survive termination.

15) Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED BY TRISEVEN APPAREL, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE SERVICE. SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF CERTAIN WARRANTIES; IN SUCH AREAS, THESE DISCLAIMERS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.

16) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TRISEVEN APPAREL AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, LICENSORS, SERVICE PROVIDERS—AND SHOPIFY AND ITS AFFILIATES—WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, REVENUE, SAVINGS, DATA, OR REPLACEMENT COSTS) ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT(S) AT ISSUE IN THE 3 MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS LIMIT SUCH EXCLUSIONS—IF SO, THIS SECTION APPLIES TO THE MAXIMUM EXTENT PERMITTED.

17) Indemnification

You agree to indemnify, defend, and hold harmless TriSeven Apparel (and Shopify), and our respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of your: (1) breach of these Terms; (2) violation of laws or third-party rights; or (3) access to or use of the Services. We may control the defense and settlement of any claim (at your expense) and will not settle any claim requiring your non-monetary obligations without your consent (not unreasonably withheld).

18) Severability

If any provision of these Terms is unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force.

19) Waiver & Entire Agreement

Our failure to enforce any right or provision is not a waiver. These Terms, together with policies posted on the site (e.g., Privacy Policy, Refund & Return Policy, Shipping Policy), constitute the entire agreement between you and us and supersede prior agreements and understandings.

20) Assignment

You may not assign or transfer these Terms or any rights or obligations without our prior written consent. We may assign or transfer these Terms without notice.

21) Governing Law & Venue

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. You and TriSeven Apparel consent to the exclusive jurisdiction and venue of the state and federal courts located in Washington State.

22) Headings

Headings are for convenience only and do not affect interpretation.

23) Changes to These Terms

You can review the most current version of these Terms at any time on this page. We may update these Terms by posting changes to the site. Where required by law, we will notify you of material changes and specify their effective date. Your continued use of the Services after changes become effective constitutes acceptance.
